This Data Processing Agreement ("DPA") forms part of the Terms of Service between you (the "Customer") and 1000896240 Ontario Inc. ("JobWorks365").
1. Roles.
You are the data controller of personal information you and your team upload to JobWorks365, including your clients' names, contact details, and payment information ("Customer Data"). JobWorks365 acts as data processor and processes Customer Data only to provide the services.
2. Instructions.
We process Customer Data only on your documented instructions and as necessary to provide the services, unless required by law.
3. Confidentiality.
Everyone at JobWorks365 who handles Customer Data is bound by confidentiality obligations.
4. Security.
We apply appropriate technical and organizational safeguards to protect Customer Data.
5. Sub-processors.
We use the sub-processors listed at jobworks365.com/subprocessors. We will notify you before engaging a new sub-processor that handles Customer Data.
6. Data subject rights.
We will assist you in responding to access, correction, deletion, and portability requests relating to Customer Data.
7. Breach notification.
If we discover a breach affecting Customer Data, we will notify you without undue delay.
8. Return and deletion.
When your account is closed, you may export your data for 30 days. After that we delete or anonymize Customer Data, except where the law requires retention.
